What is mediation?

Mediation is an informal, non-binding process involving a neutral third party who works with the litigants and their counsel to attempt to settle the suit by mutual agreement. The Mediator will not decide the matter for you. Ninety-five percent of all civil cases are resolved without a trial.

What does the Mediator do?

Mediator leads the discussions among the participants to help work towards a settlement. Discussions will take place with everyone in the same room. The Mediator will also meet separately with each side. The Mediator will not give you advice or opinions about the merits of either side's case. The goal is to have the parties decide the outcome, rather than a Judge or Jury making the decision.

Do I have to settle?

The Court only requires that you be willing to discuss the possibilities of settlement. If the parties cannot reach agreement, the case proceeds to trial before the court.

Is the mediation private and confidential?

Ohio law protects the confidentiality of mediation. Generally, no participant may reveal what is said unless all the parties agree. The Mediator is prohibited from discussing the mediation with anyone, including the Judge.

Who will be there?

All participants who are willing to mediate which has an interest in the case and can make a settlement agreement to reach a resolution to the conflict.
